Legal Aid WA offers free or low-cost legal services to the community. Legal Aid WA provides a wide range of services for family law and children’s matters. The majority of family and children’s matters are heard in the Family Court of WA and the Children’s Court at Perth.

However, nearly all of regional offices can provide advice and representation to people involved in protection and care applications, and on a range of family law issues. Please note: For the safety and well-being of all clients and staff, Legal Aid WA offices are providing assistance and services during COVID-19 by telephone.

Kununurra Aborginal Legal Service

Legal Advice

ALSWA provides legal advice during weekday office hours for Family Law issues about children. Lawyers also represent parents in protection proceedings in the Children’s Courts throughout WA and at times, in the Family Court of WA about parenting issues.

ALSWA family law staff make sure courts that deal with family law and protection issues know about cultural matters that apply, such as communication styles, how children are raised, and the importance of children and family in Aboriginal and Torres Strait Islander cultures.

Legal Advice

Kimberley Community Legal Centre lawyers can help you to plan for your safety, speak with the Police or apply for or vary a Violence Restraining Order. They can speak to you before you attend FDR to give you advice on your rights and options before you go to FDR.

Child Witness Service: Kununurra

Legal Advice

The Child Witness Service helps children and young people under 18 years of age who may need to give evidence in court. The children involved can be victims or witnesses to any criminal charge, in any court.

The Child Witness Service provides practical information and helps children and young people emotionally prepare for court. Support is provided on an individual basis. Evidence is never discussed.

The Child Witness Service does not provide counselling. However, referrals can be made to appropriate agencies when additional support is required.

The Child Witness Service aims to:

  • Reduce trauma for children giving evidence in court by appropriate preparation and support.
  • Undertake assessments of a child’s needs in relation to giving evidence and advocate for the child to receive their entitlements under the legislation.
  • Work with the WA Police Force and the Director of Public Prosecutions to ensure a child witness and their family are kept fully informed about the progress of a case through the courts
  • Help a child witness prepare a victim impact statement, even if the child is not required to give evidence

Family Advocacy Support

Legal Advice

FASS provide support and legal help if you are affected by domestic and family violence and have a family law issue.
They can help you if you have experienced domestic and family violence or someone says you have used violence.
The Family Advocacy and Support Service lawyers can assist by:
  • Arrangements for children
  • Domestic Violence Orders (known as Family Violence Restraining Orders or FVROs)
  • Property after separation
  • Divorce
  • Child Support
  • Child protection
  • Applying for legal aid
  • Some urgent court matters
The Family Advocacy and Support Service support worker can assist by:
  • Help you plan for your safety
  • Talk to the Family Courts about your safety at court
  • Give you information and support during your family law case
  • Help with practical problems like Centrelink and housing
  • Advocate for you with services like police
  • Connect you with men’s behaviour change programs or other services
